The number of these visas issued each year is limited by United States law. Your visa petition may be approved by the USCIS (United States Immigration and Citizenship Service) but an immigration visa number may not be issued to you immediately. Don’t be surprised if years pass between applying for an immigration visa and the State Department granting you an immigration visa number! Limitations on the number of immigration visas available by country are governed by U.S. law as well. If your country has a high demand for U.S. immigration visas your wait could be longer.
Becoming an immigrant involves a multi-step process. In most cases a relative or employer submits your immigration petition. There are exceptions: some applicants like investors and priority workers can petition on their own behalf. The petitioner is notified of approval by USCIS. The Department of State also receives the approved petition from USCIS. They keep it until an immigrant visa number becomes available. You (the beneficiary seeking the visa) will be notified twice, once when the petition is received and then again when an immigrant number is available. If you are currently in the U.S. you can choose to change to permanent resident status. You’ll be notified to go to the U.S. consulate near you to complete the processing if you are outside the United States.
A preference system is used to issue immigrant visa numbers. If you are the immediate relative of a United States citizen (including spouses, parents, and unmarried children under 21) you do not need to wait for an immigrant visa number to become available. It is approved immediately. Other relatives of U.S. citizens including adult children, and brothers and sisters, must wait for visas to become available. There is an order of preference.
Immigration based on employment also has a preference order for the granting of immigrant visa numbers. Priority workers, for example outstanding researchers and professors and people with extraordinary abilities, are given first preference.
You could try your luck with the Green Card Lottery. Each year 50,000 permanent resident visas are offered in a randomly selected lottery process. If you meet the strict but simple eligibility requirements you could be selected. It is designed to give immigration opportunities to people from countries other than the countries that are the main source of immigration to the United States. It is an official United States government programme aiming to diversify the population through immigration. Participation in the Diversity Visa Programme (Green Card Lottery) is free, and entries must be submitted electronically. The popularity of this lottery is evidenced by the fact that the lottery for 2011 is now closed and the one for 2012 is open!! So whichever way you decide to go, U.S. immigration could take years for approval.
